Mayor:     Thank you Ms. Bodkins. It’s a pleasure to see you all here tonight. Before we begin our regular meeting we’re going to have a public hearing relating to a proposed annexation out along W. Georgia Road AXZ-2007-04. I’ll bet some of you are familiar with that so I won’t give you all the details but.

 

OPEN PUBLIC HEARING ON AXZ-2007-04

Mayor: Let’s begin by just opening the hearing to anyone who would like to speak. And why don’t we ask anyone who is opposed to this to speak first. And what I’d like for you to do is come to the podium and identify yourself and then we’ll give you 2-3 minutes or whatever you think you need to talk to us and that way we can get it in the minutes, if you’re on the microphone we can get it into the minutes. So, anyone here to speak in opposition to this annexation request. Yes sir.

 

•  George Smith –

I’m here representing myself and my brother James Smith who he is a land owner in the proposed annexation. This afternoon as I was preparing the packet of objections that I gave last week to the Planning Commission I once again looked at the plat of the proposed annexation and remembered something my brother had pointed out before. If Mr. Dyrhaug has a plat of it could he put it up please.

 

Mayor:     I’ll bet he does. He may have to warm up for just a second, if you’ve got a joke you want to tell us or something like that you can. If you folks over here can’t see it and would like to feel free just to move over this way. I’m sure those folks won’t mind if you slide over.

 

Mr. Smith:   I’ve got to put my glasses on. Okay as I said, I noticed something that my brother had pointed out before. His point made me re-read Title V, Chapter 3, § 305 Continuous Property Defined. Which I would like to read the first sentence of now. “For purposes of this chapter contiguous means property which is adjacent to a municipality and shares a continuous border.” Parcel number 7 if the Council would look at it closely. Although it is adjacent to the City of Simpsonville it does not share a continuous border with the rest of the proposed annexation and thus does not meet this definition. As such, it cannot be counted as a yes vote and without it Mr. Poole does not have the required 75% vote as prescribed by SC Code of Law for this petition. This in itself should be enough to stop this petition.

Mayor:     Anyone have any questions. I think we’ll probably get some comments from Mr. Dyrhaug in just a moment about that so thank you very much. All right, next. Yes ma’am.

 

•  Joyce Pendarvis

I’m Joyce Pendarvis. Are the property owners identified on this.

 

Mayor:     I think those names over to the right that are numbered 1-12 aren’t those the property owners Mr. Dyrhaug.

 

Ms. Pendarvis:   Yeah, I see now. I oppose the annexation because of the congestion or traffic on W. Georgia Road at the present time. We schedule our doctor’s appointments and therapy sessions after 8:30 a.m. because we cannot get out into W. Georgia Road with the congestion of traffic as it is now and it’s as bad if not worse with soccer moms and what not in the afternoon. People coming home from work. It’s dangerous trying to get off of 385 onto W. Georgia and with the annexation of the property and the development, two cars per home or condominium that will only add to the congestion of traffic. According to the paper this morning they’ve scrapped the addition of lanes to W. Georgia , the State has. And we have dealt with the State for 2 ½ years in the widening of W. Georgia . We’ve been lied to, we’ve been misled, encroached upon and have had bulldozers in our driveway removing mud from the run-off, not to mention the destruction of a fish pond that had been there 40 years that the DOT denied any responsibility for the water – but they had piled dirt on the other side of the creek and all the run-off came on us so there it was. But my main point is the congestion that we already have on W. Georgia Road , any further development will make the situation worse. Thank you.

 

Mayor:     Okay, thank you. All right anyone else want to speak in opposition. Okay, going once, going twice. All right anyone who would like to speak in support of this. Yes sir. If you’ll just tell us your name for the record then you may begin.

 

•  Russ Poole

I’m the culprit here, I’m Russ Poole. I am a realtor with Clyde Realty here in Simpsonville. I have my client Mrs. Ann Stenhouse sitting back here in the back. She has contracted me to sell this property for her. We’ve had a contract since November. We attempted to go through the County Planning and Zoning process. This property is already targeted to be a commercial node in the W. Georgia Road corridor. There is 3 C-2 properties there now, there’s an NC property there now. I went to them and talked to them on her behalf and they said well we’ll let you do NC there. NC would limit us on a 12.8 acre tract to a 30,000 square foot building. So that would leave us with an 11 ½ acre parking lot, which didn’t make a lot of sense to us. Our other alternative would have been we could have sub-divided, went with an NC and maybe put some condos or something that is going to create a traffic problem there. We do have a contract at this time on this property, contingent on your decision on our request. I don’t see where this is going to create a traffic problem. At this time there is probably, let’s see there’s 16 housing developments between Standing Springs Road and Fork Shoals Road, probably 21-22,000 homes in there. Any one of them want a hamburger, guess where they go. There’s nothing over there, they’re going to come down they’re going to hit Rocky Creek and take it to Harrison Bridge and then into Fairview to get their hamburgers or go to the doctor or whatever. We’ve got interest in this property that would actually alleviate that. We’ve got some quality people looking at the property. If you would annex it in and rezone it for us and I’m open to any questions you all may have about what we’re doing.

 

Mayor:     Have you done any preliminary traffic studies.

 

Mr. Poole:   The last traffic count on Standing Springs Road was 13,000 cars a day now.

 

Mayor:     What impact would you expect – I know you can’t speak for these other properties but the development that your specifically talking about.

 

Mr. Poole:   And I’m talking about number 4 to clarify and confirm that is the Stenhouse property. I don’t see an impact because what we’re going to do – people that are driving by that property now to go to point A or point B will probably stop there, instead of continuing on a two-lane road such as Rocky Creek, Stenhouse Road, any of those. This is going to be a destination and I’ll tell you what I would love to see our friends out at the Coach House come out and put a meat and three there. We need a bank, you can’t get a check cashed out there. There is no place to cash a check, there’s no medical facilities out there. So that is our thought. I’ve got neighbors and friends standing behind me back here tonight and I hope we leave that same way, but I’m looking out for Ms. Stenhouse’s best interest and that’s the reason I’m here. Any other questions.

 

Mayor:     So the answer to the question was no, you haven’t done any studies.

 

Mr. Poole:   No, I’m sorry Mayor, no I don’t see it creating any impact. I see it probably diminishing some of the traffic flow.

 

Mayor:     I mean but no you haven’t done any preliminary traffic studies or.

 

Mr. Poole:   No, no sir, I haven’t done a preliminary.

 

Mayor:     Anyone have any questions. All right. Anyone else to speak in support. Okay, I probably should have started off with you Mr. Dyrhaug and so we could give some other people thoughts, so go ahead and tell us what your assessment of this situation is – I know you’ve been looking at it and studying it for a while.

 

Mr. Dyrhaug:   I have a letter that I wanted to share with you. This is a letter from the Standing Springs Baptist Church that’s been written by the Chairman of the Deacons and signed by the Trustees and in a nut shell this letter indicates their desire that the other property owners along W. Georgia Road who are either directly or indirectly affected by this annexation have a louder voice in the decision of whether this proposed annexation is granted or not so they have made the decision to remain neutral in this specific matter. And let me come up and give you each a copy of this letter. I’ve prepared a staff report. I did not know thought whether you would like me to go through that at this time or when the item comes up on the Agenda at the later time.

 

Mayor:     I think that would be appropriate when the item comes up on the Agenda because we’re still in hearing mode. So do you have any input that would pertinent to this information. Maybe information or whatever that addresses some of these concerns. Without getting into too much detail because we do want to save you for the Agenda.

 

Mr. Dyrhaug:   I know the issue about the traffic came up. I did do some research to see what the plans are for that portion of W. Georgia Road . And I found in the Transportation Improvement Program which is approved by GPATS which is Greenville/Pickens area transportation study, that this section of W. Georgia Road between Neely Ferry Road and Fork Shoals Road has been identified in the transportation improvements program for widening of the existing two lane secondary road to four lanes with two way left turn lane median and that may included isolated raised landscapable median islands, sidewalks and bicycle accommodations. This is the Transportation Improvement Program that was approved in 2006 for the fiscal year 2007-2012. And I can give you copies of this portion of the program if you’d like to be able to look at that. But, I do have that at this time to respond to some of the issues and questions pertaining to the transportation impact here and what the future plans are for that area in terms of transportation.

 

Mayor:     Okay – well if you will just withhold that. Do you have a copy for each of us – why don’t you pass that out and then withhold your comments or information until we get to the agenda item. All right, I’m going to amend the rules here a little bit. Is there anyone else who would like to say anything about this annexation, either pro or con.

 

Ms. Pendarvis:   Mr. Mayor, according to the – Joyce Pendarvis again – according to the Greenville News this program has been scratched. So I don’t know when his report was prepared but the DOT said they didn’t have the money to fund the program so – it’s gone.

 

Mayor:     Well that part is correct. They don’t have the money but it hasn’t been scraped. That part was incorrect, but at any rate we appreciate your report. All right, hearing no further comment – I’ll declare this

 

Mr. Smith:   Mr. Mayor

 

Mayor:     Yes sir.

 

Mr. Smith:   I would just like to reiterate that by the law, by the S.C. Code of Laws, parcel number 7 should not be in this annexation and without it they do not have the required 75% yes vote to even bring this annexation before the council. It is outside of the law Mr. Mayor, Councilmembers.

 

Mayor:     Well I’m sure we’ll have some clarification of that or some discussion about it once he makes his report. Thank you very much. All right, so that concludes the Public Hearing. That part of our meeting is adjourned. Now we’ll get into our regular meeting.

APPROVAL OF MINUTES OF 09/11/07 and 09/25/07

Mayor:     Council Members you have in your packet the minutes of September 11 th and September 25 th meeting. I’m sure you’ve all carefully reviewed those. I’ll entertain a motion in that regard. Ms. Lawrence

 

Ms. Lawrence:     Mr. Mayor I make a motion we approve the minutes of September 11 th and September 25 th as written.

Ms. Bagwell:   Yes sir we do. I mentioned to Ms. Bodkins on Page 7 of the minutes from the last meeting, the 25 th , at the bottom of page 7 after we’ll look into that by Mr. Hawes you need to add my name. I made a comment that you had just inadvertently put under Mr. Hawes’ name right up to the Mayor’s comments.

 

Ms. Bodkins:   Okay

 

Mayor:     How were my comments were they okay.

 

Ms. Bagwell:   Yours were fine.

REVIEW OF MONTHLY REPORTS

Mayor:     I’m sure you’ve all reviewed the monthly reports from our Department Heads and thank you gentlemen for preparing those for us and presenting them to us. Does anyone have any comments or questions regarding those at this time. All right, well we don’t have much to say but we certainly appreciate your doing it and we appreciate everything that you do. Thank you for preparing those.

 

CITIZEN COMMENTS

Mayor:     This is the portion of the meeting where we invite citizen comments, but we only had one person sign up and that was Mr. Smith. And Mr. Smith you spoke at the hearing but I’ll – if you have anything else you’d like to add I’ll give you the opportunity to

 

Mr. Smith:   I have plenty more I could say but I will let it go at this.

COUNCIL COMMENTS

Mayor:     All right. Council comments. Are there any of you who have any wisdom to bring to us tonight. Ms. Lawrence.

 

Ms. Lawrence:     Yes Mr. Mayor, thank you. The Home Depot has asked me to sincerely thank the Fire Department and the Police Department for taking part in their safety Saturday, which was this past Saturday. Evidently there was a lot of people there. There was a workshop that the kids made the fire trucks and things out of wood that Home Depot provided for them. But once again thank you and Chief Reece and Chief Majors if you would tell your men that participated thank you so much. And that’s from the Home Depot.

 

Mayor:     Great, thank you Ms. Lawrence. Anyone else. Mr. Larson

 

Mr. Larson:   I was going to see if the Chief would give us a little report on what happened at CVS several days ago.

 

Mayor:     You should keep a wireless microphone back there and you wouldn’t have to walk this far.

 

Chief Reece:   That’s all right. Mr. Larson I guess you want me to tell a funny story is that what you want. I think Mr. Hawes sent out an e-mail to you all. We had an armed robbery at CVS about 5:00 in the afternoon. And what was so funny about it was the guy came out of the store and ran down the street and he was trying to pick him up a ride because his ride left him I guess when he figured out he was doing an armed robbery. So he goes running out the door waving, trying to flag down a ride. What he didn’t realize was it was our traffic officer in that blue camaro who certainly did give him a ride. It was just hilarious. It was one of those things that ought to be on dumb crooks. He got a ride. We caught him within one minute of the armed robbery so that I was proud of the guys.

 

Mayor:     I suppose that lowered our response time average by a couple of minutes.

 

Chief:     It ought to. Thank you.

 

Mayor:     All right. Mr. Zitricki

 

Mr. Zitricki:   Thank you. I spoke with Chief Reece earlier about some traffic issues back in Powderhorn. People running stop signs and he’s going to take care of that for us. Also, since Mr. Hawes isn’t here would Mr. Dyrhaug be able to answer questions about the streetscape project.

 

Mayor:     I’ll bet he can answer every question that comes up.

 

Mr. Zitricki:   How is that progressing. I see a lot more work going on out there.

 

Mayor:     He may not answer it quickly but he’ll answer it.

 

Mr. Dyrhaug:   My hesitancy probably shows that I’m not well equipped to answer that question. To be honest with you I don’t know the progress that it’s been making. As you’ve indicated Mr. Hawes has mostly been incorporated in that. Mr. Carter I know has had some involvement as well. He may shake his head yes or no whether he has any additional input to provide us, but other than that I’m sorry that I don’t have any more information.

 

Mr. Zitricki:   Well have there been any complaints about interrupting business, or the owners…..

 

Mr. Dyrhaug:   I haven’t heard any.

 

Mr. Zitricki:   I haven’t heard any either.

 

Mayor:     I see a nodding no back there so…I’ve talked with – for your information – I’ve talked with a couple of merchants there – not all of them certainly and they’re very understanding and very appreciative and they understand there’s a little short term pain here but it’s going to be a great gain for them once it’s completed.

 

Mr. Zitricki:   The working is picking up so it’s causing a little more hinderance to the businesses.

 

Mayor:     Yeah it’s moving a little faster since it left City Hall. Once it got past City Hall it started moving pretty quickly. All right. Anyone else. All right, thank you council.

 

OLD BUSINESS

•  Request from SIMBA for Fall Festival and Santa’s Workshop

Mayor:     All right next on the Agenda is Old Business and I’ll bet we have a representative from SIMBA here tonight. Anji Nelson are you here? There you go. Well if you’ll come forward and sort of remind us about the request you made at our workshop meeting.

 

Ms. Nelson:   Yes the request is for the Simpsonville Downtown Business Development Association’s Fall Festival and Santa’s Workshop. And basically what we’re asking to do is to borrow the utility flat bed truck from Department of Public Works to use as a stage and to block off a portion of South Main Street from the Train Depot about mid-way towards the clock tower for the duration of the events. Fall Festival will be from 11:00 a.m. to 3:00 p.m. and Santa’s Workshop will be from 11:00 – 2:00 p.m. And Santa’s Workshop would be on December 1 st and the Fall Festival is October 27 th . Both of which are Saturdays.

 

Mayor:     October 27 th .

 

Ms. Nelson:   October 27 th for the Fall Festival and December 1 st for Santa’s Workshop.

 

Mayor:     Okay, and I’m sure you’ve talked with Chief Reece about the traffic and I see – is that a thumbs up. Okay I see a thumbs up from there. So – I guess Mr. Parliamentarian we need a resolution.

 

Mr. Holmes:   A simple motion.

 

Mayor:     Would somebody make a motion to approve or disapprove or however you want to word your motion. Ms. Lawrence.

 

Ms. Lawrence:     I make a motion that we allow SIMBA to use part of South Main Street that they have so stated on October 27 th and December 1 st .

•  Election of Election Commission Member

Mayor:     All right, Ms. Bodkins your going to tell us about all of our applicants and nominees for the position of Election Commission Member.

 

Ms. Bodkins:   Yes sir. I didn’t prepare a ballot for you tonight because we only had one application and that was Justin Chandler. And that’s the only application you received. So you need to vote on him whether yeah or nay tonight.

 

Mayor:     Well I would recommend Mr. Parliamentarian that we just do a voice vote and I’ll call on the nominator to tell us a little bit about this gentleman once again. And I believe that was Mr. Larson.

 

Mr. Larson:   Right, Justin Chandler is a life-long resident of Simpsonville. His family has been in the area for 7 generations. He is a graduate of the Citadel. He’s a member of the Greenville City Police Department and he’s been involved in Simpsonville activities for many years and I think he should be a good candidate.

 

Mayor:     Okay, I will entertain a motion in that regard.

 

Mr. Larson:   I make a motion that we vote to approve Justin Chandler to the Election Commission.

 

Mayor:     All right do I hear a second

 

Ms. Lawrence:     Second

 

Mayor:     Ms. Lawrence seconds. Any discussion. Anybody know anything about him we ought to know. I think most of us have met him and talked with him and he seems okay so far. ANNEXATIONS/REZONINGS

•  AXZ-2007-04 12 properties along W. Georgia Road

Mayor:     All right. Next item on the Agenda Annexations and Rezonings. Mr. Dyrhaug this is where you get to do your thing regarding AXZ-2007-04 which is the 12 properties along W. Georgia Road that have been much discussed already this evening.

 

Mr. Dyrhaug:   All right. As you’re aware we have a petition that the City has received wherein at least 75% of the freeholders owning at least 75% of the assessed values of the properties have signed this petition requesting annexation into the City of Simpsonville . As you indicated in total this is 12 properties that have been included on the petition and 9 of those properties have signed the petition. On this map behind me these 12 properties are shaded in pink. The properties that have signed the petition are the properties numbered 1-9. Properties number 10-12 have not signed that petition. Staff has reviewed this petition and we’ve found that it is a valid petition with the exception of one property which is at the intersection of W. Georgia Road and East Standings Springs Road , it’s number 5 on this map. That property is currently zoned as C-3 in the county and the remainder of the properties included in the petition are currently zoned R-S in the county. All 12 properties are requesting a rezoning to PD within the City. By a vote of 6-1 the Simpsonville Planning Commission has voted to recommend to the City Council approval of the requested rezoning planned development. Staff opines that would be very beneficial for the City to have some input regarding the development of this corridor as has been discussed already this evening. There’s indication on the Transportation Improvement Program prepared by GPATS that this area of W. Georgia Road is to anticipate future expansion and this corridor is also really accessible from I-385 and is in a good location relative to a number of residential subdivisions. And so for these reasons the pressure for commercial development along this corridor is going to continue to increase, regardless of whether it’s annexed into the City of Simpsonville . And so staff supports the approval of this petition for annexation and rezoning to the planned development zoning district.

 

Mayor:     Before I ask for a motion, let me ask just one basic question. What say you regarding parcel number 7 about being contiguous.

 

Mr. Dyrhaug:   When I did my initial review I found this whole annexation petition to be valid. That not being an issue. I’d have to go back and review the state laws wording to see if that is an issue and perhaps review that with Mr. Holmes here. But, as far as I’ve reviewed to this point I found this petition to be valid.

 

Mayor:     Is parcel number 7 separated from the road right-of-way by anything other than the property line or anything that you know. So I believe – can you address that Mr. Holmes.

 

Mr. Holmes:   Well I’ll be glad to address it. A legal issue has been raised and obviously I need to go back and look at the petition. As I look at the map the issue is not – that this gentleman is raising is not whether it’s contiguous to the City limits, because it clearly is based on this map. State law makes it quite clear that a road does not disturb the contiguous nature of a property. I believe what he’s trying to claim is the statute requires that all of the parcels that are to be annexed must be contiguous to each other. And I just have to go take a look at that. And I’ll be glad to do that but I’m not prepared to do that tonight.

 

Mayor:     Okay, all right, well I’ll entertain a motion so that we can discuss this somewhat. Mr. Zitricki

 

Mr. Zitricki:   Would a motion to Table this until we’ve had time to review this be in order.

 

Mr. Holmes:   A motion to Table is always in order.

 

Mr. Zitricki:   Well I don’t feel comfortable voting on this one way or the other until we get this legal issue resolved so I make a motion to table AXZ-2007-04 until Mr. Holmes has time to review the legal issue on parcel number 7 and get back with us.

 

Mayor:     All right I have a motion to table, I don’t believe that requires a second, is that correct?

 

Mr. Holmes:   No sir.

TEXT AMENDMENTS

•  TX-2007-03 Ordinance to require specified survey standards

Whereby County land records may be improved.

Mayor:     All right, next item. Mr. Dyrhaug you’re still up. You want to talk to us about some text amendments.

 

Mr. Dyrhaug:   Right. Thank you Mayor. This next item is a review of Ordinance number TX-2007-03 which is an ordinance which would amend the Land Development Regulations to apply consistent standards for final plats whereby the county land records may be improved. The GIS Division for Greenville County is working on ways to improve both the accuracy of geographic data and the timeliness in which that geographic information is made available to the City and to the public through their internet mapping system and shared data. This proposed ordinance attempts to improve both of these aspects of this service. Standards contained in this proposed ordinance have already been adopted by Greenville County and the City of Fountain Inn and it’s in the process of being adopted by the City’s of Mauldin and Travelers Rest. It will improve the accuracy of geographic information through the application of a uniform coordinate system and it will increase the timeliness in which that’s input by requiring submission via digital formats as CAD files. By unanimous vote of 7-0 the Planning Commission has voted to recommend to the City Council approval of this Text Amendment TX-2007-03. And staff is also in full support of this proposed text amendment and likewise recommends its approval.

Mayor:     Ms. Bagwell. Thank you Ms. Bagwell. Any discussion. I think we discussed this pretty thoroughly at the workshop meeting so I think everybody knows what’s going on. All right, hearing no further discussion I’ll call for the vote. All those in favor signify by saying Aye (AYE) opposed No. Aye’s have it it’s unanimous.

EXECUTIVE SESSION

•  Legal Matter – Fire Department

Mayor:     We do have a need for an Executive Session to discuss a legal matter regarding the Fire Department. So I’ll entertain a motion in that regard. Mr. Zitricki

 

Mr. Zitricki:   I move that we adjourn for Executive Session to discuss a legal matter for the Fire Department

 

Mayor:     Thank you Mr. Zitricki. Do I hear a second

 

Mr. Bridges:   Second

 

Mayor:     Mr. Bridges seconds. All in favor signify by saying Aye (AYE) opposed No. Aye’s have it it’s unanimous. We are in recess going into Executive Session.

Came out of Executive Session at 7:42 p.m. No action was taken.
